Section 53-3-109, applicable provisions of the Driver's Privacy Protection Act contained in 18 U.S.C. Chapter 123 and Government Records Access and Management Act contained in Title 63, Chapter 2 of the Utah Code.

Notice is provided that both Utah and federal law authorize the imposition of criminal penalties against any person or entity for the violation of the Driver's Privacy Protection Act or the Utah Government Records Access and Management Act. See 18 U.S.C. Section 2723 and Utah Code Ann. Section 63-2-801. In addition, the Drivers Privacy Protection Act permits a civil action to be brought against any person or entity who improperly obtains, uses or discloses protected information. See 18 U.S.C. Section 2724. Such civil actions permit the court to award actual damages in an amount not less than $2,500, punitive damages and attorney fees.
