Course Outline & Objectives: | This seminar will review the current requirements that subcontractors must satisfy in order to maintain a construction lien an/or bond claim in Utah, Including Preliminary Notice, Notice of Lien and Prosecuting Bonds, and, Lien Foreclosure Actions.
Attendees will also discuss alternative negotiating strategies concerning adverse construction contract terms, including the Pay-If-Paid Clause, No Damages for Delay, Change Order Requirements, Notice of Claims and Dispute Resolutions Clause, Lien Waiver Terms and other topics.

He has been a member of the American Bar Association Forum on the Construction Industry for over 25 years and is licensed to practice law in Utah and Wyoming. His practice has been primarily devoted to Construction Law for over 35 years, with his emphasis being representation of Subcontractors and Specialty Contractors in contract negotiation, claims disputes, litigation, mediation, and arbitration. He is general counsel for the Utah Mechanical Contractors Association and has served as Chairman of the Utah Bar Litigation Section and Chairman of the Utah Supreme Court Advisory Committee for Civil Jury Instructions. |
