| Course Outline & Objectives: | Don?t wait until after a claim arises before you take steps to protect yourself. Avoiding defect claims begins as early as when the contract is signed. This course will review ways to avoid the expense of nasty construction defect claims, which are on the rise. Indeed, homeowners are now asserting claims for defects that have not even appeared but which may occur in the future. In this course, you will learn ways to reduce your liability including contract language, course of dealings, notices, testing and inspections and cautionary actions during construction.
This course will also include a discussion of how Codes, ES Reports and Manufacturer specifications work together to avoid defects in the field and how to manage best industry practices. A study using field examples of Code deficiencies and when codes are not observed. |

Prior to attending law school, Mr. Sundloff worked for as a project manager and landscape architect at an architecture/engineering firm in Salt Lake City. While there Mr. Sundloff frequently worked with owners, developers, design professionals, contractors, and material suppliers on retail developments in Utah and Idaho. Mr. Sundloff was involved in all aspects of the design process of a project including, initial concept and site planning, entitlements, construction documents, bidding, and construction observation. Additionally, just prior to attending law school, Mr. Sundloff worked for as a senior planner at the Utah office of a national transportation engineering and planning firm. These experiences have given Mr. Sundloff a broad understanding of the construction and development industry and an ability to recognize the interests of those entities involved in the design and construction process.

After practicing in San Diego, David decided it was time to come home to Southern Utah. His practice areas include commercial litigation and estate planning. His commercial litigation practice includes, construction defect defense, construction law, mechanic?s liens, contract litigation, collections law, civil litigation, general real estate, real estate development, real estate disputes, real estate transactions, real estate foreclosures, banking, arbitrations and mediations. His estate planning practice includes asset protection, and helping clients design and implement wills, revocable trusts, irrevocable trusts (insurance trusts (ILITs), intentionally defective grantor trusts (IDGTs), charitable remainder and lead trusts (CRTs and CLTs), powers of attorney, health care directives, and other estate planning documents. He obtained his undergraduate degree from B.Y.U. and earned his Juris Doctorate from J. Reuben Clark Law School (B.Y.U.). He began his legal career in 1996 with Fisher, Scribner & Stirland, a small litigation firm in Provo, where he began developing a civil litigation practice. He now works for Dixon, Truman, Fisher & Clifford which has offices in St. George and Las Vegas. His firm emphasizes construction law and real property litigation.
In addition to practicing law, Nathan is a Judge Pro Tem in the Fifth Judicial District Small Claims Court in St. George. He is impressed by the responsibilities of that position and enjoys the opportunity to serve. Nathan is currently serving on the Southern Utah Home Builders Association Education committee which is dedicated to improving our membership through continuing education. He has conducted lien law seminars instructing our general membership in the intricacies of Utah and Nevada Mechanics Lien Laws.
